Welcome to ProTrackFit. By accessing our website, creating an account, and using our software-as-a-service (SaaS) platform, you agree to be bound by these Terms and Conditions.
1. Acceptance of Terms & Eligibility
By creating an account, you represent that you are at least 18 years old and fully capable of entering into a legally binding agreement under the Indian Contract Act, 1872 or applicable international law. If you are using ProTrackFit on behalf of a business or coaching entity, you represent that you have legal authority to bind that entity to these terms.
2. Service Description
ProTrackFit provides a digital workflow platform, analytics dashboard, and automated WhatsApp bot integration designed for fitness coaches, trainers, and nutritionists to manage client check-ins, weight tracking, and macro estimations.
warning3. Medical & Fitness Disclaimer (Assumption of Risk)
ProTrackFit is strictly an administrative, operational, and calculation software platform. ProTrackFit is NOT a medical organization and does NOT provide medical advice, diagnosis, treatment, or clinical nutrition prescriptions.
All nutritional calculations, macronutrient breakdowns, and workout tools generated by our algorithms or Artificial Intelligence (AI) are informational approximations only. Coaches are solely and exclusively responsible for reviewing, adjusting, and taking professional responsibility for all recommendations, meal plans, or workout guidance delivered to their clients.
Coaches and clients assume all risks associated with their diet, supplementation, and exercise programs. Users should always consult a licensed physician or medical professional before commencing any new diet or vigorous physical training.
4. Acceptable Use and Account Abuse
You agree not to misuse the ProTrackFit platform. Specifically:
- You may not create multiple free-tier accounts to circumvent pricing limits ("free-tier stacking"). Detected accounts will be permanently suspended without notice.
- You may not use our WhatsApp API integration to send spam, unsolicited promotions, harassment, or any content that violates Meta's WhatsApp Business and Commerce Policies.
- You must provide truthful and accurate information during sign-up.
5. Subscriptions and Payments
ProTrackFit operates on tiered subscription models (Free, Starter, Growth, Pro, Elite). Paid subscriptions unlock higher client roster limits and advanced features. Payments are processed securely via verified third-party payment gateways (including Razorpay). Subscriptions are billed in advance on a recurring or term basis according to your chosen plan.
6. Limitation of Liability
To the maximum extent permitted by applicable law, ProTrackFit, its founders, and affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of the service. ProTrackFit is not liable for any personal injury, health outcomes, or disputes between a coach and their clients.
7. Governing Law & Dispute Resolution
These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the competent courts in India.
